Affiliate Terms + Conditions

as an affiliate, you accept the following terms & conditions upon sharing your referral link with others:

1. You must use your personal referral link to refer customers to the oily moon collective subscription. If a customer fails to use your referral link, we will not be responsible for paying out a commission. Our referral program was activated on 10/19/2021. Any referrals prior to this date will not be paid out retro-actively. 

2. We will pay you 10% commission for each new customer who subscribes to the oily moon collective using your personal referral link. You can manage your commissions & find your referral link by logging into your account and selecting the “affiliates” dashboard. We will also pay 10% recurring commissions each month that referred subscriber maintains their active membership. Your commission for that customer will cancel/expire on the date their subscription is cancelled.

3. The start of the customer’s subscription is determined by the date of their first sign up for the oily moon collective. You will receive a commission payment for the oily moon collective subscription transaction only, regardless of any additional purchases made by that customer during their subscription service for other oily moon products. The affiliate is not entitled to any commissions except for those mentioned above related to the oily moon collective. No commissions for other products in our store will be paid.

4. Commissions will be paid once a month around the 18th of each month via paypal.

5. To be eligible for the affiliate program, you must be an active oily moon collective subscriber. If at any point you cancel your oily moon collective subscription, your affiliate status will be terminated and you will no longer receive any future commissions for referred subscribers. You must maintain an active monthly subscription to remain an affiliate. 

6. This program does not license you to any software or proprietary rights. You agree not to copy, rent, lease, sell, distribute, or create derivative works based on the oily moon collective content.

7. Termination Without Cause. Either you or we may end this Agreement AT ANY TIME, with or without cause, by giving the other party written notice. Written notice can be in the form of mail, email, or facebook post in our oily moon collective group. In addition, this Agreement will terminate immediately upon any breach of this Agreement by you.  No future commissions with be made payable to you upon termination of this affiliate program.

No Indirect Damages. TO THE EXTENT PERMITTED BY LAW, IN NO EVENT SHALL EITHER PARTY BE LIABLE FOR ANY INDIRECT, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS OR BUSINESS OPPORTUNITIES.

Limitation of Liability. IF, NOTWITHSTANDING THE OTHER TERMS OF THIS AGREEMENT, WE ARE DETERMINED TO HAVE ANY LIABILITY TO YOU OR ANY THIRD PARTY, THE PARTIES AGREE THAT OUR AGGREGATE LIABILITY WILL BE LIMITED TO THE TOTAL COMMISSION AMOUNTS YOU HAVE ACTUALLY EARNED FOR THE RELATED CUSTOMER TRANSACTIONS IN THE TWELVE MONTH PERIOD PRECEDING THE EVENT GIVING RISE TO A CLAIM.

Affiliate Tool. WE DISCLAIM ALL LIABILITY WITH RESPECT TO THE AFFILIATE TOOL THAT YOU USE.  WE DO NOT PROMISE TO MAKE THE AFFILIATE TOOL AVAILABLE TO YOU, AND WE MAY CHOOSE TO DO SO, OR NOT TO DO SO, IN OUR DISCRETION.

Cookie Duration. COOKIES USED AS PART OF THE AFFILIATE TOOL HAVE A SET DURATION. IF A POTENTIAL CUSTOMER CLEARS THEIR COOKIES DURING THIS PERIOD, OILY MOON ESSENTIALS SHALL NOT BE LIABLE FOR ANY COMMISSIONS THAT MAY HAVE BEEN OWED TO YOU.
